On the French coast regulations are the same as in France : over 16 year old, only day sfishing, no torch, no close to nets, only by freediving, anual licence/ insurance is mandatory...
From Gand case/ Rocher Créole to Gallion is there a protected maritim area were sfishing is not allowed. You have to be carefull with the boats++ and using a float equiped with a flag is mandatory. Ciguaterra is everywhere (cuda..) |

That's a little different than what I received from a dive shop in the island...
"You can spear fish on the French side outside of the Marine Park - so you would be in about 60ft or deeper of water or deeper chasing after a Mahi Mahi or Tuna. You would also need a boat to "prove" to authorities that you were not fishing in the shallower water. There are lots of fish that you can't eat here due to Ciguaterra poisoning. Spear fishing on the Dutch side is unfortunately not actually illegal - however it is illegal to have a spear gun without a license." thescubashop.net So, I guess I'm still looking for clarification. It wasn't on the original countries list, but in the British Virgin Islands spearfishing is sadly illegal (either on scuba or whilst freediving).

I saw this while surfing SCDNR site. Its proposed legislation. But what I found interesting is that Gig apparently includes spear. I've not noticed that before.
'Gig' means a device consisting of a staff with a sharp point or points designed for thrusting and used to take fish by hand; to take fish by hand by use of a spear, prong, or similar device. http://www.scstatehouse.gov/sess119_...bills/3864.htm Apparently you can, or may soon be able to use goldfish as bait. It is unlawful to use any nonindigenous fish as bait that is not already established in the water body being fished except the following minnows: fathead minnows (Pimephales promelas), golden shiners (Notemigonus crysoleucas), and goldfish, including 'black salties' (Carassius auratus).
